Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Peak Collective, LLC dba User Kudos("we", "us", or "our"). By accessing or using User Kudos ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

The Service

User Kudos provides an embeddable feedback widget, dashboard, and related tools for collecting product feedback from your website visitors. Features and limits depend on your subscription plan.

Your account

You are responsible for maintaining the security of your account and API keys. You must provide accurate registration information and comply with applicable laws when collecting feedback from your users.

Acceptable use

You agree not to:

• Use the Service for unlawful, abusive, or deceptive purposes
• Attempt to bypass usage limits, security controls, or billing
• Upload malicious code or interfere with the Service infrastructure
• Collect sensitive personal data without proper consent and safeguards

Billing

Paid plans are billed in advance through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period unless otherwise stated. Refunds are handled according to our refund policy at the time of purchase.

Disclaimer

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Peak Collective, LLC dba User Kudos is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

Indemnification

You agree to indemnify and hold harmless Peak Collective, LLC dba User Kudos and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, violation of these Terms, or infringement of any rights of a third party.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including but not limited to ownership, warranty disclaimers, indemnity, and limitations of liability) shall survive.

Peak Collective, LLC dba User Kudos has appointed a Data Protection Officer (DPO) responsible for overseeing data protection strategy and ensuring compliance with GDPR and other applicable privacy laws.
